Chapter 13 bankruptcy, is the type of bankruptcy that allows people to conserve some of their assets by continuing to pay down debts on a repayment plan. The repayment plan is for 3 to 5 years and establishes a payment amount that takes into consideration your income and ability to pay. At the end of the repayment plan, a person should be on good footing with mortgage payments and out from under the shadow of foreclosure. I work with my clients to help them create a payment plan that is affordable and reasonable for them.
Similar to Chapter 7, filing bankruptcy under Chapter 13 allows for many types of personal debts to be discharged as part of the bankruptcy. Also, filing for bankruptcy under Chapter 13 puts your creditors on notice and stops creditor harassment and as part of the debt repayment plan it will stop foreclosure or a repossession of a vehicle.
Chapter 13 bankruptcy is a good alternative for those people with a regular income who are looking to conserve assets, such as a house or car. These people may be facing a foreclosure or repossession from falling behind on payments and would benefit from a reasonable payment plan.
