Chapter 7 offers people a fresh start with a discharge of most types of debts. Chapter 7 is most appropriate for those people who have serious and extensive debts and do not have the resources to pay back those debts.
With chapter 13, people are usually able to maintain their assets, such as a house or a car, by creating a repayment plan that is set at a reasonable amount given their current income level. At the end of the repayment period, typically three to five years, you are in good standing with your payments.
Bankruptcy is not the only avenue for debt relief and is not right for everyone. People need to understand their options so they can make decision on how to proceed. If bankruptcy is not the best option, I will help my clients with other alternatives to alleviate their debt including negotiating with their creditors.
